Generally, you have 120 days from the date that appears on the decision in order to appeal the Board decision to the U.S. Court of Appeals for Veterans’ Claims. It is crucial that you contact an attorney as soon as possible after receiving your Board decision, as failing to do so can negatively impact your rights.

You may still be able to appeal the decision if you can demonstrate good cause for not appealing in time. You should file an appeal immediately and contact an attorney as soon as possible.

The Court requires a $50 fee in order to file an appeal. However, the Court can waive this fee if the claimant has a financial hardship that makes its payment difficult.

Yes. The U.S. Court of Appeals for Veterans Claims allows an attorney licensed with the Court to represent anyone, regardless of where the client is located.

Nothing. The firm’s representation is of no cost to you. If the firm is successful, then it will seek fees from the government pursuant to the Equal Access to Justice Act. 28 U.S.C. § 2412. Whether you win or lose, you will not be responsible for paying the firm for its representation.
